"Recientes reformas constitucionales en América Latina: una primera aproximación".

RESUMEN
Numerosos países de América Latina –Ecuador, Chile, Brasil, Colombia, Paraguay,
Perú, Bolivia, Argentina, Guatemala y Nicaragua– han encarado en los últimos años
procesos de reformas constitucionales. Haciendo frente a problemas comunes, éstas
también incluyeron respuestas bastante similares. Este trabajo tiene como propósito
analizar crítica y comparativamente varios de los principales temas abordados en
dichas reformas: la de la justicia y el consejo de la magistratura; los frenos y
contrapesos, congreso vs. ejecutivo; los derechos sociales; la participación política, y,
por último, discurre sobre el ideal de la “representación plena” y la crisis del poder
legislativo. Señalando en todos los casos los alcances y límites, el objetivo central del
autor es contribuir a la discusión de los graves problemas subsistentes en las reformas
constitucionales finalmente acordadas.
SUMMARY
In recent years, many Latin American countries (Ecuador, Chile, Brazil, Colombia,
Paraguay, Peru, Bolivia, Argentina, Guatemala and Nicaragua) initiated a process of
constitutional reforms. Since many of the problems these countries faced were alike,
the responses given to those problems in the new reforms were also similar. The aim
of this paper is to make a comparative and critical analysis of some of the main issues
tackled in the reforms: those of justice and council of the judiciary, the checks and
balances, the congress and the executive, the social rights, and political participation.
Finally, it considers the ideal of "full representation" and the crisis in the legislative
branch. The paper is intended as a contribution to the discussion about the serious
problems that approved constitutional reforms still have, pointing out in every case their
scope and limitations.
