UE, MEDIDAS DE AUSTERIDAD Y DERECHOS SOCIALES EN
GRECIA (2010-2015)

Desde los años noventa y especialmente desde el año 2009, está teniendo lugar en
Grecia la desintegración paulatina de los rasgos típicos del constitucionalismo social. La
presente ponencia hará un repaso a las medidas adoptadas desde 2010 hasta hoy en el
país heleno y analizará el grado de implicación que la Unión Europea y sus estructuras
de gobierno y funcionamiento ha tenido y tiene en este fenómeno de desmantelamiento
del Estado social, planteando dos tesis principales.
En primer lugar, a la luz de la evolución normativa de la integración comunitaria,
consideramos que es imprescindible revisar el discurso de la socialdemocracia
europeísta acerca de la existencia de un “modelo social europeo” que cohabita de
manera pacífica y coordinada con el de los Estados miembros. Así, sostendremos a lo
largo de esta obra que no existe un “constitucionalismo social multinivel europeo” que
haya actuado como un instrumento jurídico garantista de los derechos sociales de los
ciudadanos.
Al contrario, y esta es la segunda tesis, mantendré como idea fuerza de la ponencia que
la UE se ha conformado, con especial claridad en las últimas décadas, en el principal
instrumento de los poderes financieros para proceder al desmontaje del proyecto
garantista de derechos sociales construido en el siglo XX en los dos niveles
mencionados, el constitucionalismo social interno y el constitucionalismo social
externo.
Justificadas ambas ideas a partir del estudio del caso griego, intentaré, finalmente,
responder a la pregunta ¿qué opciones jurisdiccionales y políticas le quedan a Grecia
para reconstruir un sistema de garantías de estos derechos? A analizar los posibles
escenarios que podrían darse y las consecuencias de cada uno de ellos se dedicará la
última parte de la comunicación.

Since the nineties and especially since 2009, it is taking place in Greece the gradual
disintegration of the typical features of social constitutionalism. This presentation will
review the measures taken from 2010 to today in the Hellenic country and analyze the
degree of involvement that the European Union and its structures of governance and
operation has had in this phenomenon of dismantling the welfare state, raising two main
thesis.
First, in light of the regulatory evolution of community integration, we consider that it is
essential to review the European socialdemocracy discourse about the existence of a
"European social model" that coexists peacefully and coordination with the State
members. So, we will hold throughout this paper that there isn’t a "European social
multilevel constitutionalism" that acted as a guarantor legal instrument of social rights
of citizens.
On the contrary, and this is the second thesis, I will keep as a strong idea of the paper
that the EU has been, particularly clear in recent decades, the main instrument of
financial powers to proceed with the dismantling of the social rights guarantor project
built in the twentieth century in these two levels: internal social constitutionalism and
external social constitutionalism.
Justified both ideas from the study of the Greek case, I will try to finally answer the
next question: ¿what jurisdictional and policy options remain to Greece to rebuild a
system of guarantees of these rights? To analyze the possible scenes that could occur
and the consequences of each of them the last part of the communication will be
dedicated.
