In view of the seriousness of this matter and on the basis of the facts which have thus far been presented to me, I am recommending to the
Superintendent that your child be ADMINISTRATIVELY ASSIGNED TO Opportunity School/recommended for expulsion (circle one), in
accordance with School Board Policy 5610 from MIAMI-DADE COUNTY PUBLIC SCHOOLS. If expelled, your child may be assigned to the
Work Back Program at the discretion of the Superintendent or designee.
We have informally discussed the misconduct with your child who has been presented with the evidence. Also, your child has been given an
opportunity to present his/her side of the story.
Attached is a copy of your child's Student Case Management Record showing other incidents (if any) and the school's attempt(s) to provide
help.
The regulations at 34 CFR 300.530(h) provide parents of students with disabilities with certain rights. Parents must be notified of these rights
when school personnel remove a student with disabilities who violates the Code of Student Conduct from his or her current educational setting
for more than 10 school days. More than 10 school days means 10 school days in a row or a series of removals of more than 10 school days.
Parents must be notified of the removal decision and be provided with a copy of their procedural safeguards on the same day of the removal
decision.
You and your child have a right to an informal hearing on the matter of the ten (10) day temporary assignment and my recommendation for
expulsion. You may arrange a hearing by calling the school at the number indicated below. During the duration of the temporary assignment,
your child should attend the Pathways program at _________________________ and should not return to the school campus during that
time. An unauthorized appearance could result in a charge of trespassing

for that day by the referring school. If the student is absent from Pathways the student's attendance for that day only will be placed in ISIS
as a U "Unexcused Absence" by the referring school.

En vista de lo grave de este asunto y teniendo en cuenta los hechos que me han presentado, estoy recomendando al Superintendente que su hijo sea
ASIGNADO POR ACCIÓN ADMINISTRATIVA A un Opportunity School/recomendado para ser expulsado (circule uno) de acuerdo a la Política 5610 de la Junta
Escolar de las ESCUELAS PÚBLICAS DEL CONDADO MIAMI-DADE. Si fuese expulsado, su hijo puede ser asignado al programa Work Back Program, a la
discreción del Superintendente o su delegado.
Tuvimos una conversación informal con su hijo sobre su mala conducta y se le presentaron las pruebas. A su hijo también se le ha brindado la oportunidad de
presentar su versión de los hechos.
Adjunto encontrará una copia del récord del control del caso del estudiante (Student Case Management Record) que indica otros incidentes (si es que hubiese
algún otro) y los esfuerzos de la escuela para proporcionarle ayuda.
El Código de la Regulaciones Federales 34 CFR 300.530(h) proporciona ciertos derechos a los padres de alumnos con discapacidades. Los padres
de un estudiante con discapacidades que haya infringido el Código de Conducta del Estudiante tienen que ser notificados de estos derechos tan
pronto como el personal escolar suspenda al estudiante de su ámbito educacional por más de diez (10) días. Más de 10 días escolares significa 10
días escolares consecutivos o una serie de suspensiones de más de 10 días escolares. Los padres deben ser notificados de la decisión de
suspender al estudiante y se le debe entregar una copia de las garantías procesales el mismo día que se tomó la decisión de suspenderlo.
Usted y su hijo tienen el derecho de solicitar una audiencia informal respecto a la asignación temporal de diez (10) días y de mi recomendación de que sea
expulsado. Puede llamar a la escuela para solicitar una audiencia al número que se indica a continuación. Mientras que dure la asignación temporal, su hijo
debe asistir al programa Pathways en ___________________________________________________________ y no debe volver al recinto escolar durante
ese tiempo. Si hace acto de presencia sin estar autorizado puede que se le impute un cargo de (allanamiento de morada)
